Tienda Comercio Textil Zara y Lefties firman aucerdo covid 19

a) Tres mañanas, tres tardes.

a) INVIERNO.

AGREEMENT SIGNED BETWEEN CC.OO., UGT AND ZARA/LEFTIES SPAIN

It was a necessity. The de-escalation in the state of alarm, with the reactivation of commercial establishments in an environment of preventive measures, entails the implementation of complex organisational measures, where a significant number of rights are at risk of being overlooked.

Within this framework, in which the negotiations of adaptation measures to the new reality must support the reintegration of the workforce, and where the needed speed in decision-making, the monitoring of the right to health and the complexities of all of this, together with the new need for collective conciliation, have made this negotiation absolutely necessary.

The pretence of being able to set a roadmap for the better development of these negotiations that the committees will face, has served to, firstly, correct business approaches in which as trade unions we had seen serious threads.

Thus, the following points have been defined:

  • The exceptional measures agreed shall be temporary, all of which are subject to the completion of the de-escalation or the authorisation to return to normal activity from the health legislation.

  • New organisation of shifts, in accordance with the healthcare guidelines, with 3 proposed options to be agreed in each workplace with the legal representation of the workers:

Three mornings, three afternoons.

A week in the morning, a week in the afternoon.

Fixed morning and afternoon shifts.

If this implied a reduction in weekly working hours from the usual, the difference in hours will be considered as “paid and recoverable” until 31 January 2021.

  • Regards, in any case, to reductions in working hours. As a fundamental right in conciliation, which must also be considered from the point of view of safety and the right to health.

  • Holidays. Respecting the conventional rules (collective agreements).

  1. WINTER. Any periods pending being taken must be used by 15th of June of 2020.

  2. SUMMER. Extraordinary planning in accordance with the RLT, establishing, if necessary, limitations on the number of people working per shift.

  • Relocation of workplace and/or roles. Under the fundamental premise of protecting jobs and health, and of temporary nature.

  • Measures for labour conciliation and flexibilization of the Equality Programmes. Now more than ever, the conciliation needs are urgent for almost the totality of the staff.

  1. Paid and recoverable leave due to need to balance family circumstances, deferring some of the working hours to a later time in the year and readjusting the extra pay in the case of not being able to work the deferred hours.

  2. Flexibilization of the unpaid and/or recoverable leave due to family conciliation up to 14 years.

  3. Adapt and specify working hours without reduction, for those with relatives with a disability equal to or greater than 33%.

  4. People entitled to the reduction of hours established in Article 37.6 of the Statute of Workers Rights, possibility to accumulate the periods of reduced shifts for full days, if the person resides abroad or has a disability greater than 33% or is legally recognised as dependent. This leave is cumulative to the period of holiday regardless of the place of residence of the minor.

  5. Priority in the choice of holiday period for single working parents with children under 14 years.

  6. Leave of absence for up to two months with job security to cover personal needs, which may be joined to paid leave with adequate justification.

  7. Provision of greater flexibility to adapt time concretions to the new needs of working people, always on a voluntary basis.

  • Monitoring committee. Establishment of this body which will serve the purpose of ensuring the correct implementation of the agreed measures, and to determine how the measures within this agreement are to be adapted in the face of the situations that may arise in these uncertain times.

Both trade unions value favourably this agreement that brings forward the will of the social bodies to collectively reach a “new normality” safeguarding employment.
